These Terms of Service ("Terms") are a binding agreement between you and Skyen Systems Pty Ltd (ACN 701 564 730), a company registered in Victoria, Australia ("Skyen Systems", "we", "us"), governing your use of worksheeta.com and the Worksheeta application (together, the "Service"). Worksheeta is a product of Skyen Systems. By creating an account or using the Service, you agree to these Terms.
1. Acceptance of these terms
By accessing or using the Service — including the three free trial worksheets available without an account — you agree to be bound by these Terms and by our Privacy Policy, Acceptable Use Policy, and Refund & Payments Policy, each incorporated here by reference. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old to create a Worksheeta account or to use the Service in any capacity. By registering, you confirm that you meet this requirement and that you are using Worksheeta as a teacher or education professional for legitimate teaching purposes. Worksheeta has no student accounts and is not directed at anyone under 18.
3. The service
Worksheeta lets teachers generate reading-comprehension worksheets from text they supply, upload, or ask us to write, tailored to a chosen curriculum (US, UK, Australia, or Canada) and level, and produces a printable worksheet together with a separate answer document. We may add, change, or remove features from the Service over time; we will not remove a feature described in these Terms as included in a paid plan without providing reasonable notice to affected subscribers.
4. Your account
- You must provide accurate registration information and keep it up to date.
- You are responsible for safeguarding your password and for all activity that occurs under your account.
- Notify us immediately at hello@worksheeta.com if you suspect unauthorised access to your account.
- Accounts are for individual teachers. Sharing a single paid account across multiple teachers, or creating multiple accounts to exceed free-tier allowances, is a breach of these Terms and of our Acceptable Use Policy.
5. Plans, allowances, and billing
Worksheeta offers a free trial, a Free plan, and paid Worksheeta Pro plans:
- Trial: three worksheets, usable without creating an account.
- Free: five worksheets per calendar month, requires a free account.
- Worksheeta Pro: a paid plan billed in advance through Stripe, on one of the following cycles, at the price shown at checkout:
- Monthly — 100 worksheets per billing month
- 3 Months — 300 worksheets across the three-month period
- 6 Months — 600 worksheets across the six-month period
- Annual — 1,200 worksheets across the twelve-month period
Worksheets included in a plan are available throughout the plan period and do not carry over. Any unused worksheets expire at the end of the period.
Subscriptions renew automatically at the end of each billing cycle unless cancelled before renewal. Full billing, cancellation, and refund terms are set out in our Refund & Payments Policy, which forms part of these Terms.
6. Acceptable use
Your use of the Service must comply with our Acceptable Use Policy at all times. We may suspend or terminate access for any use that violates it.
7. Content and ownership
7.1 Your content
You retain all ownership rights in the text you submit and the worksheets you generate. By submitting content, you grant Worksheeta a limited, non-exclusive licence to process, store, and display that content solely to provide the Service to you — including sending it to the third-party AI and text-recognition providers described in our Privacy Policy for the purpose of generating your worksheet. We do not use your submitted content to train any AI model, and we do not claim ownership over it.
7.2 Worksheets you generate
You may use, print, copy, and distribute worksheets you generate for your own teaching purposes, including sharing them with students, colleagues, and your school. You are responsible for ensuring your use complies with your school's policies and with copyright law where you supply your own source text.
7.3 Our content
The Worksheeta name, logo, website, software, and underlying design are owned by Skyen Systems Pty Ltd and protected by applicable intellectual property law. Nothing in these Terms grants you rights in our brand or platform beyond using the Service as intended.
8. Third-party AI-generated content
Worksheeta uses third-party artificial intelligence services to generate passages, questions, and answer keys, and a text-recognition service to read uploaded photos and PDFs. While we apply automated checks to this content before it reaches you, AI-generated output can occasionally be inaccurate, incomplete, or not perfectly suited to your request. You are responsible for reviewing any worksheet before distributing it to students. See our Disclaimer for further detail.
9. Termination
You may stop using the Service and delete your account at any time — see our Account & Data Deletion Policy. We may suspend or terminate your account if you breach these Terms, the Acceptable Use Policy, or fail to pay applicable fees, and will make reasonable efforts to notify you before doing so except where immediate action is necessary to protect the Service or other users. Sections of these Terms that by their nature should survive termination — including ownership, disclaimers, limitation of liability, and governing law — will continue to apply.
10. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by applicable law. Our full Disclaimer, including specific disclaimers about AI-generated content and curriculum alignment, is incorporated into these Terms by reference.
Nothing in this section excludes, restricts or modifies any guarantee, condition, warranty, right or remedy that you have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.
11. Limitation of liability
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
Subject to the paragraph above and to the fullest extent permitted by applicable law, Skyen Systems will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or goodwill, arising from your use of the Service. Our total liability to you for any claim arising from these Terms or the Service will not exceed the amount you paid us in the twelve months preceding the claim. Nothing in these Terms limits any liability that cannot lawfully be limited or excluded, including liability for death, personal injury, or fraud.
12. Indemnification
You agree to indemnify and hold Skyen Systems harmless from any claim, loss, or expense — including reasonable legal fees — arising from your violation of these Terms, your misuse of the Service, or content you submit that infringes the rights of a third party.
13. Changes to these terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through a notice within the Service before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
14. Governing law and disputes
These Terms are governed by the laws of the State of Victoria, Australia, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be subject to the non-exclusive jurisdiction of the courts of Victoria, Australia, except where mandatory consumer-protection law in your country of residence entitles you to bring a claim in your local courts instead, in which case that right is not affected by this clause.
This governing-law clause addresses contract disputes only. It does not override the Australian Privacy Act 1988 (Cth) as it applies to us, nor any mandatory rights available to you under the law of your own country, including the UK GDPR and EU GDPR where those apply to you.
15. General
- Entire agreement: these Terms, together with the Privacy Policy, Acceptable Use Policy, and Refund & Payments Policy, are the entire agreement between you and Skyen Systems regarding the Service.
- Severability: if any provision is found unenforceable, the remaining provisions continue in full force.
- No waiver: our failure to enforce any provision is not a waiver of our right to do so later.
- Assignment: you may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- Force majeure: neither party is liable for delays or failures caused by circumstances beyond reasonable control.
